LGBTQ Family Law Matters

The United States Supreme Court finally declared in 2015 that same sex couples have the right to marry in the United States. Shortly before that Supreme Court decision, federal court litigation in the State of Wisconsin held that Wisconsin's laws only permitting a man and a woman to marry were unconstitutional.

With the changes in laws now permitting people of the same sex to marry, we would presume parentage equality would follow, and the rights of all parents would be held by the courts equally.

Wisconsin has not however amended its laws to include same sex couples as parents. There have been "second parent" adoptions in Wisconsin in some countries, but this is not uniform throughout the state.

In 2016, the United States Supreme Court overruled the Alabama Supreme Court's ruling that a Georgia adoption by a same sex couple was not valid in Alabama.

Wisconsin must honor the adoptions of children by same sex parents in other states. So, for example, if such parents obtain a divorce in Wisconsin, they must be treated as equal parents in the divorce action.
